1.          General provisions.

    1.1. These Rules for working with personal data of Website Users www.counsels.legal (hereinafter referred to as the Rules) have been developed and applied by LEGAL OFFICE VESTA LLC (hereinafter referred to as the Operator) in accordance with subclause 2 of Part 1 of Article 18.1 of Federal Law No. 152-FZ dated 27.07.2006 “On Personal Data” (hereinafter referred to as the Law about personal data).

    1.2. These Rules define the Operator’s policy regarding the processing of personal data accepted for processing, the procedure and conditions for processing personal data of individuals who have transferred their personal data for processing to the Operator (hereinafter referred to as personal data subjects) using and without the use of automation tools, establishes procedures aimed at preventing violations of the legislation of the Russian Federation, eliminating the consequences such violations related to the processing of personal data.

    1.3. The Regulation has been developed to ensure the protection of the rights and freedoms of personal data subjects when processing their personal data, as well as to establish the responsibility of Operator officials who have access to personal data of personal data subjects for non-compliance with the requirements and norms governing the processing of personal data.

    1.4. The Policy applies to the relations in the field of personal data processing that arose with the Operator both before and after the approval of this Policy.

    1.5. In compliance with the requirements of Part 2 of Article 18.1 of the Law on Personal Data, this Policy is published freely on the Internet on the Operator’s website.

    1.6. The main concepts used in the Policy are:

           A website is a collection of graphic and informational materials, as well as computer programs and databases that ensure their availability on the Internet at a network address http://counsels.legal/;

           A user is any visitor to a website http://counsels.legal/;

           Personal data – any information related to the User of the Website http://counsels.legal/;

           Personal data processing is any action with personal data performed using computers, as well as without their use;

           Depersonalization of personal data is an action that results in the inability to determine the identity of personal data to a specific User or person without using additional information;

           Dissemination of personal data is any action that results in the disclosure of personal data to an unspecified group of people;

           Provision of personal data is any action that results in the disclosure of personal data to a certain group of people.;

           Destruction of personal data is any action that results in the irrevocable destruction of personal data on a computer or any other media.

    2.       The purpose of collecting personal data.

    2.1. The processing of personal data is limited to the achievement of specific, predetermined and legitimate purposes. Processing of personal data incompatible with the purposes of personal data collection is not allowed.

    2.2. Only personal data that meets the purposes of their processing is subject to processing.

    2.3. The processing of personal data by the Operator is carried out for the following purposes:

           ensuring compliance with the Constitution of the Russian Federation, federal laws and other regulatory legal acts of the Russian Federation;

           carrying out its activities in accordance with the Charter of LEGAL OFFICE VESTA LLC;

           providing feedback from the Operator’s Specialists on User requests;

           for other purposes, if the relevant actions of the Operator do not contradict the current legislation, the Operator’s activities, and the consent of the Personal Data Subject has been obtained for the specified processing.

    3.       Legal grounds for processing personal data.

    3.1. The legal basis for the processing of personal data is a set of regulatory legal acts, in compliance with which and in accordance with which the Operator processes personal data, including:

           Federal Law No. 152-FZ of 27.07.2006 “On Personal Data”;

           By these Rules;

           The Universal Declaration of Human Rights of 1948;

           The International Covenant on Civil and Political Rights of 1966;

           The European Convention for the Protection of Human Rights and Fundamental Freedoms of 1950;

           The provisions of the Convention of the Commonwealth of Independent States on Human Rights and Fundamental Freedoms (Minsk, 1995), ratified by the Russian Federation on 08/11/1998;

           The provisions of the Okinawan Charter of the Global Information Society, adopted on 07/22/2000;

           By Decree of the Government of the Russian Federation dated 01.11.2012 No. 1119 “On Approval of Requirements for the protection of personal Data during their Processing in Personal Data Information Systems”;

           By Order of the FSTEC of Russia dated 02/18/2013 No. 21 “On Approval of the Composition and Content of Organizational and Technical Measures to ensure the Security of Personal Data during their Processing in Personal Data Information Systems”;

           Other regulatory and non-normative legal acts regulating the processing of personal data.

    4.       Personal data to be processed.

           The Operator processes the following personal data of Users:

           Name;

           Phone number;

           Also on site is the collection and processing of anonymous data about visitors (including cookies) using Internet statistics (Yandex Metric and Google Analytics and others);

           other data required by the Operator when providing services to Users to ensure the functioning of the Site.

    5.       The procedure for collecting, storing, transferring, and other types of personal data processing.

    5.1. The Operator processes the User’s personal data only if it is sent by the User through the forms located on the website http://counsels.legal/. By sending their personal data to the Operator, the User agrees with this Policy.

    5.2. The Operator processes depersonalized User data if this is allowed in the User’s browser settings (the storage of cookies and the use of JavaScript technology are enabled).

    5.3. The operator ensures the safety of personal data and takes all possible measures to exclude access to personal data of unauthorized persons.

    5.4. The User’s personal data will never under any circumstances be transferred to third parties, except in cases related to the implementation of current legislation.

    5.5. In case of inaccuracies in personal data, the User can update them by sending a notification to the Operator via e-mail to the Operator’s e-mail address: info@counsels.cc marked “Updating personal data”.

    5.6. The period of processing personal data is unlimited. The User can revoke his consent to the processing of personal data at any time by sending an e-mail notification to the Operator’s e-mail address: info@counsels.cc marked “Withdrawal of consent to the processing of personal data”.

    6.       Final provisions.

    6.1. In the event of any disputes or disagreements related to the implementation of these Rules, the Personal Data Subject and the Operator will make every effort to resolve them through negotiations between them. If disputes are not resolved through negotiations, the disputes are subject to resolution in accordance with the procedure established by the current legislation of the Russian Federation.

    6.2. These Rules come into force for the Personal Data Subject from the moment of the start of using the Operator’s Website and are valid for an indefinite period.

    6.3. These Rules may be amended and/or supplemented by the Operator at any time during the term of the Rules at its discretion without the need to obtain the consent of the Personal Data Subject. All changes and/or additions are posted by the Operator in the relevant section of the Website and take effect on the day of such posting. The personal data subject undertakes to review all changes and/or additions in a timely manner and independently. If the Personal Data Subject does not agree with the changes made, he is obliged to refuse access to the Site and stop using the materials and services of the Site.
